1. INFORMATION FOR USERS

Who is the data controller for your personal data?

LA MOLA MOTORENT SL is the DATA CONTROLLER for the USER’s personal data and hereby informs the USER that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

For what purpose do we process your personal data and why do we do so?

Depending on the form from which we have collected your personal data, we will process it confidentially in order to achieve the following purposes:

In the “Contact” form

• To respond to requests for information or any other type of enquiry submitted by the user via any of the contact methods made available to them on the data controller’s website. (on the basis of the data controller’s legitimate interests, Article 6(f) of the GDPR)
• To carry out statistical analyses and market research. (on the basis of the data controller’s legitimate interests, Article 6(f) of the GDPR)

In the “Bookings” form

• Make bookings at the data controller’s premises. (for the purposes of performing a contract or a pre-contractual arrangement, Article 6(b) of the GDPR)
• Send commercial and advertising communications via email, fax, SMS, MMS, social media or any other electronic or physical means, present or future, to customers, enabling commercial communications to be sent regarding products or services similar to those initially covered by the contract with the customer (Article 21(2) of the LSSI). (on the grounds of the data controller’s legitimate interests, Article 6(f) of the GDPR)

How long will we retain your personal data?

It will be retained only for as long as is necessary to fulfil the purposes of the processing or for as long as there are legal requirements mandating its retention; when it is no longer required for that purpose, it will be deleted using appropriate security measures to ensure the anonymisation of the data or its complete destruction.

To whom do we disclose your personal data?

No personal data will be disclosed to third parties, except where necessary for the performance and fulfilment of the purposes of the processing, to our communications service providers, with whom the DATA CONTROLLER has entered into confidentiality and data processor agreements as required by current data protection legislation.

What are your rights?

The rights enjoyed by the USER are:

• The right to withdraw consent at any time.
• The right to access, rectify, transfer and erase their data, as well as to restrict or object to its processing.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the relevant boxes and entering data in the fields marked with an asterisk (*) in the contact form or in the downloadable forms, USERS expressly, freely and unequivocally accept that their data is necessary for the data controller to process their request; the provision of data in the remaining fields is, however, optional. The USER guarantees that the personal data provided to the DATA CONTROLLER is accurate and undertakes to notify the DATA CONTROLLER of any changes to such data.

The DATA CONTROLLER informs you that all data requested via the website is mandatory, as it is necessary to provide an optimal service to the USER. Should not all data be provided, there is no guarantee that the information and services provided will be fully suited to your needs.

3. SECURITY MEASURES

That, in accordance with the provisions of current legislation on the protection of personal data, the DATA CONTROLLER complies with all the provisions of the GDPR and the LOPDGDD relating to the processing of personal data within its remit, as well as the principles set out in Article 5 of the GDPR, according to which data must be processed lawfully, fairly and in a transparent manner in relation to the data subject, and must be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

THE DATA CONTROLLER guarantees that it has adopted appropriate technical and organisational measures to implement the security measures provided for by the GDPR and the LOPDGDD, in order to protect the rights and freedoms of USERS, and that it has provided them with the necessary information to enable them to exercise those rights.
