General Terms and Conditions
FIRST – GENERAL TERMS AND CONDITIONS FOR VEHICLE LEASE
1.1 These General Terms and Conditions govern the contractual relationship between K y C Motorent S.L., under the name “La Mola Rent”, (“the Lessor”) and the client (“the Lessee”), by virtue of which the former grants the latter the use of a vehicle for the term, price, and other conditions established in the rental agreement.
SECOND – APPLICABLE LEGAL REGULATION
2.1 These General Terms and Conditions are subject to the provisions of Royal Legislative Decree 1/2007, of November 16, approving the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, amended by Law 3/2014, of March 27; Law 44/2006, of December 29, on the improvement of consumer and user protection, the regional regulations in force in the place where the service is provided, as well as any other regulations that replace, complement, or modify the foregoing, where applicable.
2.2 The Lessee is obliged to comply with the General Rental Conditions of the country where the service is provided.
THIRD – USE OF THE VEHICLE.
3.1 The Lessee undertakes, for the duration of the rental period, that the vehicle will be used and driven in accordance with the regulations of the Highway Code, as well as in accordance with any other traffic or parking regulations in force at the place and time in which the rented vehicle is used. If, in the event of non-compliance with the aforementioned obligation by the Lessee and/or any other driver during the rental period, an authority requests the Lessor to identify the Lessee, the Lessor will provide the Lessee’s details in accordance with the applicable regulations. Thus, failure to comply with the obligation established in point 3.1 of this clause will entitle the Lessor to claim compensation from the Lessee, which in no case may exceed 25 euros per case.
3.2 The Lessee is required to always carry a copy of the current rental agreement with them throughout the duration of the rental.
3.3 If the vehicle is used to transport minors with a height equal to or less than 135 centimeters, the Lessee must always provide approved child restraint systems suitable for the minor using them. They must install them in the vehicle under their own responsibility, in accordance with current traffic regulations and the manufacturer’s instructions. Likewise, if the Lessee requests such a child restraint system from K y C Motorent S.L., the former assumes all responsibility for its verification, correct installation in the vehicle, and use. The Lessor assumes no liability for personal and/or property damage, whether direct or indirect, arising from the installation, failure to verify, and/or use of the mandatory restraint system by the Lessee.
3.4 The vehicle may only be used on public roads.
The following are expressly prohibited:
a) Driving the vehicle on unauthorized or unpaved roads, or roads whose condition could pose a risk to the safety and integrity of the vehicle or a risk of damage to it;
b) Participating with the vehicle in races, speed and/or endurance tests, contests, or challenges of any kind;

l) Driving within ports, airports, aerodromes, and/or similar areas not accessible to public traffic, as well as in the premises or facilities of refineries and oil companies, unless expressly authorized in writing by the Lessor.
m) Accessing prohibited areas with the vehicle without prior express written authorization from the Lessor.
3.5 The Lessee must ensure that the vehicle’s load is correctly distributed and safely positioned, always respecting the authorized weight, quantity, and/or volume limits indicated on the Vehicle Registration Permit and/or the Vehicle Inspection Record. Likewise, the Lessee is responsible for ensuring that the number of occupants in the vehicle does not exceed the authorized limit indicated on the Vehicle Registration Permit and/or the Vehicle Inspection Form.
3.6 The Lessee is prohibited from transferring, subleasing, renting, mortgaging, pledging, selling, encumbering, or in any way giving as security the vehicle, the rental contract, the keys, documentation, equipment, tools, and/or accessories, and/or any other part or component thereof; or from using the foregoing in a manner that causes harm to the Lessor.
3.7 The use of the vehicles is limited to the territory of the island of Formentera. Use outside this territory will result in the cancellation of the contract, as well as the cancellation of any additional insurance policies, and an additional charge for misuse of the vehicle will be imposed (see condition 12.6). In the event of use and breakdown outside the delimited territory, the Lessee will be responsible for the transportation costs of the vehicle until it is returned to the company at an authorized location.
FOURTH – FORMALIZATION OF THE CONTRACT
4.1 At the time of formalizing the rental contract, the Lessee and any other person designated in the rental contract as the driver must be present and present valid driving licenses valid in the country of rental, as well as their corresponding valid personal identification documents. The Lessor reserves the express right to refuse rental of the vehicle if the Lessee or any other person designated in the rental contract as the driver fails to properly prove their identity or hold a valid driving license at the time of formalizing the rental contract. Digital or electronic driving licenses will not be accepted unless expressly permitted by applicable regulations. The vehicle may only be driven by the Lessee.
4.2 The following will be considered valid for driving in Spain:

– Permits from countries that are issued in accordance with Annex 9 of the Geneva Convention or Annex 6 of the Vienna Convention, or that differ from these models only in the adoption or deletion of non-essential sections.
– International permits accompanied by the original foreign driving license.
These permits will be valid provided that:
a)The maximum period of six months from the date of acquiring normal residence in Spain has not elapsed. After this period, the aforementioned permits are no longer valid for driving in Spain, and, if you wish to continue driving, you must exchange the permit for an equivalent Spanish one, or, if this is not possible due to the lack of an agreement with your country of origin for the exchange, obtain a new Spanish permit. https://www.dgt.es/nuestros-servicios/permisos-de-conducir/permisos-extranjeros-y-de-fuerzas-y-cuerpos-de-seguridad/canjes-de-permisos/paises-con-convenio-de-canjes/
b)The driver’s license is valid.
c)The holder is of the required age in Spain to obtain an equivalent Spanish license.
IN ANY CASE, AN INTERNATIONAL DRIVING LICENSE IS MANDATORY FOR NON-EU COUNTRIES.
4.3 The Lessee shall be personally and jointly liable for the persons who drive the vehicle during the rental period.
4.4 Without prejudice to the Lessee’s liability to third parties, if any of the obligations set forth above are breached, the Lessor may terminate the contract with immediate effect and claim compensation for damages, including lost profits, caused by the breach in question.
4.5 The following documents are required for vehicle collection:

Service hours are from 9:00 a.m. to 9:00 p.m. After this time, the Lessor is authorized to withdraw from the vehicle until 9:00 a.m. the following day. In this case, it is the Lessee’s responsibility to ensure the safety of the vehicle and that of other persons. In the event of a vehicle breakdown that prevents it from being properly returned to the Lessor within the aforementioned hours, the Lessee acknowledges that they will be informed of the permanent telephone number available during business hours for notifications. Therefore, the Lessee’s inability to notify the Lessor about the breakdown or the inability to return the vehicle will not be a reason for exemption from liability.
SIXTH – “LA MOLA RENT” RENTAL CONDITIONS
6.1 The Lessee receives the vehicle in perfect working order, which they will verify upon taking over. They acknowledge that they have been informed of the type of fuel the vehicle requires and undertake to return the vehicle in the same condition as received.

Likewise, the company may withdraw the rented vehicle if it is deemed to be misused, or if the vehicle is being driven while in poor physical condition of the driver due to alcohol, drugs, fatigue, and/or illness. Under no circumstances will the rented vehicle be subleased or driven by anyone other than the contracting customer, unless expressly authorized by the Lessor.

The amount thus determined – if applicable, the deductible – will be claimed from the Lessee along with other damages such as towing, tolls, damage appraisal, processing of the case, and any other items, always in accordance with current legislation. The Lessee has the right to receive a copy of the appraisal. If the amount cannot be determined this way, it will be determined by the repair shop’s estimate. The amount of compensation payable by the Lessee for a total loss will be the market value of the vehicle prior to the appraisal at the time of the incident. 16.1 In the event of an accident, theft, fire, damage caused by animals or by natural disasters, and in general in any case of damage, the Lessee or driver must notify the police or appropriate security agency immediately, and do everything possible to protect the interests of the Lessor. Notifying the police of the incident will also be mandatory in the event of an accident due to the Lessee’s own fault and/or without the intervention of a third party, and especially when the vehicle is immobilized or when continuing to drive it would pose a danger to traffic safety. If it is not possible to contact the police, the Lessee or driver must report the incident to the nearest police station personally. They must also complete a descriptive accident report (Friendly Declaration), whether at fault or not, and with or without the involvement of a third party. In the event of a crime being committed, if there are injuries and/or if the culpability of those involved needs to be investigated, it is the Lessee’s obligation to immediately report the incident to the police.
16.2 In the event of an accident involving a third party, the Lessee must complete the Accident Report using the standard form found in the vehicle’s documentation and immediately notify the Lessor in writing, and always within a period of no more than 24 hours, of all the details of the accident. This includes a copy of the report, the original of which must be delivered within a maximum of two days. If the other party refuses to sign an Accident Report, the Lessee must request the presence and assistance of the police and must also provide the Lessor with a copy of the corresponding report.
16.3 The Accident Report must be filled in completely and with as much detail as possible, regarding both, the damage and the circumstances under which it occurred. The Lessee undertakes to sign the Accident Report and to obtain the signature of the other party, if applicable. If the other party refuses to sign, the Lessee must request the presence of the police on-site to clarify the facts, otherwise the Lessee will be considered responsible for the accident, unless proven otherwise by the Lessee.
16.4 The Lessee or driver must take all necessary and appropriate measures to clarify the accident. This includes, in particular, the duty to answer the Lessor’s questions regarding the circumstances of the accident completely and truthfully, and the duty not to leave the scene of the accident before the necessary and significant investigations have been carried out, in particular, to enable the Lessor to assess the accident, as well as the duty not to impede the Lessor’s ability to carry out such investigations. The Lessee authorizes the Lessor to request a copy of the accident report or certificate from the relevant authority or law enforcement agency.
16.5 The accident or theft of the vehicle does not automatically imply an obligation on the part of the Lessor to make a replacement vehicle available to the Lessee.
SEVENTEENTH – TERMINATION OF THE CONTRACT
17.1 The parties shall have the right to terminate the contract if there is a legal reason to do so. The Lessor shall have the right to terminate the contract with immediate effect if the Lessee is more than seven days late in paying any amounts due, or if there is another just cause.
In this sense, the following will be considered just cause:
-The return of receipts, checks, or charges to the card or payment method provided, or failure to comply with the payment terms previously agreed upon with the Lessor, unless the Lessee makes payment within seven days.
-If the Lessee uses the vehicle in a manner unsuitable for its intended purpose or causes damage to the vehicle through intent or gross negligence, including failure to perform maintenance or inspections when required.
-Violation of applicable transport provisions.
-Failure to comply with any of the prohibitions included in these General Conditions.
-And, in general, when, given the circumstances, the continuation of the leasing relationship is not required, for example, in the event of a high accident rate or repeated exceeding of the maximum mileage.
17.2 In the event of termination of the contract, the Lessee is obligated to immediately return the vehicle, keys, documentation, and accessories. In any case, the Lessor has the right, upon termination of the contract, to remove the vehicle from its location.
17.3 In the event of termination of the contract, the Lessor may claim damages resulting from the termination, which includes not only consequential damages (including towing, appraisals, legal costs, etc.) but also lost profits due to the unavailability of the vehicle (which will be established based on the certificate on lost profits due to vehicle downtime issued by the National Business Federation of Rental Vehicles with and without Driver (FENEVAL), which determines the daily amount of the downtime).
EIGHTEENTH – GENERAL PROVISIONS
18.1 The Lessee has the right to receive a copy of these General Conditions in English, and also in Spanish, as stated in the versions written in other languages. In the event of discrepancies, the Spanish version will prevail.
18.2 The offsetting of credits will operate in accordance with current legislation. In this sense, the security deposit can only be reimbursed after verifying that the Lessee has fulfilled all of their obligations.
18.3 If there is more than one Lessee or driver, they will all be jointly and severally liable to the Lessor.
NINETEENTH – PRIVACY POLICY
19.1 In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights, we inform you that your personal data is included in our files for the purpose of providing and offering our services.
